IMCR provides mediation services under the Early Intervention Mediation program. This program assists families with infants or
toddlers (0-3 years old) in which there is either a developmental delay or a disability. In Early Intervention Mediation the law guarantees every parent with the right to mediation or an impartial hearing to resolve a dispute in which the parent disagrees with the determination made by an evaluator or with an Early Intervention official. This right was established with the passage of Title II-A of Article 25 of the Public Health Law (1933)
Under this law the parents are ensured that they shall have the right to a procedure that:
1) is voluntary
2) occurs when requested by the individual receiving early intervention services, unless constrained by regulation
3) is conducted by a qualified and impartial mediator who is trained in effective mediation techniques and,
4) the mediation is not used to deny or delay the right of the individual (s) to other due process rights, such as an impartial hearing.
